What is Form I-9?

Form I-9, Employment Eligibility Verification, is a U.S. Citizenship and Immigration Services (USCIS) form that verifies a worker's identity and authorization to work in the United States. Every employer must complete one for each person they hire.

This is the current 08/01/2023 edition. Unlike tax forms, the I-9 is not filed with any government agency — the employer keeps it on file.

What is the I-9 used for?

It documents that an employer has verified each new hire is legally allowed to work in the U.S. The employee attests to their status in Section 1, and the employer records the documents they examined in Section 2.

Who needs to complete an I-9?

Both parties to a hire: the employee completes Section 1, and the employer (or an authorized representative) completes Section 2. Every employee hired to work in the United States must have one, including U.S. citizens.

Section 1 vs Section 2

  • Section 1 — Employee. Your name, address, date of birth, optional SSN, and an attestation of your citizenship or work-authorization status. You sign it by your first day.
  • Section 2 — Employer. The employer examines your original documents and records them within three business days of your start date.

How to fill out Section 1

  1. Open the form in the editor — the current I-9 loads ready to type into.
  2. Enter your name — last, first, middle initial, and any other last names used.
  3. Add your address and date of birth; your SSN is optional unless your employer uses E-Verify.
  4. Attest to your status — citizen, noncitizen national, lawful permanent resident, or authorized to work.
  5. Sign and date Section 1, then download the PDF for your employer.

Acceptable documents

For Section 2, you show your employer either one document from List A, or one from List B plus one from List C:

  • List A (identity + work authorization): U.S. passport, Permanent Resident Card, or Employment Authorization Document.
  • List B (identity): driver's license or state ID.
  • List C (work authorization): Social Security card or birth certificate.

When is the I-9 due?

Section 1 must be completed by the employee's first day of work. Section 2 must be completed by the employer within three business days of the start date.

Where is the I-9 kept?

Employers do not submit the I-9 to USCIS or any agency. They retain it for as long as the person works for them, plus three years after the date of hire or one year after employment ends, whichever is later, and present it if audited.
